Is your spouse hiding assets from you?

You are ready to call it quits and walk away from your marriage. You know that Louisiana is a community law state, which means you should get roughly 50 percent of your marital assets. Here is the thing; you think your spouse is hiding assets from you in an effort to keep more for him or herself. What can you do?

While hiding assets from the divorce process is illegal, that does not stop people from trying to do it. If you think your spouse is hiding assets, you can take steps to try to track them down.

Step number one: Search the house

When it comes to assets, there is always a paper trail. You may be able to find bank statements, life insurance policies, retirement account information and other account information by looking through files in your home or other hiding spots. In searching the house, you may also find cash or other valuable pieces of property stowed out of sight.

Step number two: Research online

It is easy to perform a public record search online. In doing so, you may find other names your spouse uses, information about relatives, names of business associates and even social media profiles. This information can be used to track big purchases, discover affairs and figure out to whom your marital assets are going.

Step number three: Keep track of your finances

In many marriages, only one spouse takes care of all the financial information. If it has not been you up to this point, now is the time to start checking your accounts. You can find a wealth of information, such as:

  • If funds are being transferred
  • To whom the funds are being transferred
  • If big purchases are being made

If your account is bled dry and you do not know why it makes it difficult to fight for your fair share of the remaining assets.

Step number four: Seek help

If you are looking everywhere you can possibly think of because you believe your spouse may be hiding assets but you are struggling to uncover anything of use to your case, get help. Legal counsel and forensic accountants can work together to search and possibly find any assets your spouse may be trying to keep to him or herself. Searching for hidden assets can drag out your divorce proceedings, but it will prove worth it in the end when you walk away with a fair property division settlement.
